GALA Board Members Sound Off

In a letter to the Editor, Glenwood Acres Landowners Association Board Secretary Billy Sipes and At-Large Member A.C. Floyd express their shared views on the ongoing tension between the board and unhappy landowners.

The time has now come for we two Glenwood Acres Landowners Association board members to make a statement. It appears that Mr. Tim Cariker is trying to make his statements as if they were the ideas, thoughts and views of all board members. We would like to set that record straight.

We believe that the board is, and should be held accountable for its actions. In the past, as well as now, it seems that things have gotten out of control insofar as what the true, legal and just actions and duties of this board consist of. We are the caretakers for the monies for the Association, and as such, we should be ever mindful that wasteful, careless and unnecessary spending should stop. We owe it to the people to spend their money wisely and for good reason. We further believe that the people have a right to see with their own eyes what is being done with the monies. What has happened recently is that monies have been spent without board approval and other directives have been carried forth, also without the complete board membership being involved in the decisions.

We should never lose sight of our duties nor our goals. When any money is spent, it should be carefully considered and weighed before such action is taken. The people who pay their dues have a right to know where and for what their dues money is spent. A full accounting should be made to the people. The idea of ruling any board with the concurrence of a select few is not acceptable in any way. We are entrusted with the duties of making certain that whatever we do is for the betterment of Glenwood Acres and at the same time it is not infringing on the rights of others.

If one will look back in history, they will find that any attempt at controlling a group of people with tyranny and total disregard for their constitutional and civil rights will only serve to cause a justifiable uprising of the people. This is what is now occurring here at Glenwood Acres. The voices of the people are crying out for equality, justice and a desire to be heard. But these same voices are being silenced by a few board members who feel that the people have no say-so and should just let the few continue with their actions.

The situation of allowing a paid employee to dictate who can and who cannot remain on Glenwood Acres property is not acceptable either. This paid employee could use a course in attitude, as well as a course on how to treat others who enter the office of this association. If you owned a business, it would be beneficial and profitable, not to mention imperative, that you greet your customers with a warm and friendly dialogue upon their entering your establishment and not make them feel as though you are doing them a favor to see to their needs.

The validation of the petition to impeach board president Jason Lundy was a farce. There were names who were stricken because their dues were not paid by January 12, 2009. We find it not only improper, but very strange that this was done. It appeared to us that the paid employee was seeking to discredit and invalidate as many signatures as she possibly could in order that the petition would fall short of the needed number. We also find it appalling that a target number was never provided in order that the person who was directing the impeachment drive would have no idea what the actual number of valid signatures he would need to bring the matter to full vote actually was. The request was made several times for the total number of members in good standing, but that number was never provided.

We hold steadfast in our beliefs that the board does need some changes and that those who are not willing to serve the citizenry with faithfulness, honesty and with compassion should resign their respective positions and then they could be replaced by others who are willing to be a voice for the people without regard to their financial, political or personal beliefs. It is also our belief that a mockery should be made of no one because of their disabilities or impairments.

This association is supposed to be for the people and by the people and certainly not the wishes of any one board member or select group of board members. Sadly, what is now happening is that if you are not in favor of the old business-as-usual group, without any accountability, then you are considered as "against the board". That is not the way it is, at all, because we both know that it can be done with the interest of the people at the heart of all matters and that the old business-as-usual tactics are not in the best interest of the people nor the association.

We are both willing to be representatives of the people and will insure that the rights of the people, as well as the voices of these same people be heard and not silenced. At present, that is hard to do because of a certain few who do not wish to do the will of the people.

The time has now come for those who wish to serve honestly to step forth and be recognized and those who do not wish to do the same should vacate their respective seats in order that someone who will work for the benefit of the members and the association can then be placed in that capacity.

We would like to thank Mr. DeWayne Spell of the Upshur Advocate for his honest and unbiased coverage of the matters at hand concerning Glenwood Acres.

well maybe some light can be shed here on a 600.00 dollar check written from the assn.(by lundy without the board meeting to discus it)(see A) to earnest hoyle for the cleanup of lot on elm i blieve that to be the street where the brush piles made very large piles and earnest has burned some of them as well as charged the neighbor living next to it 250.00 to remove some items from this mans property that the owner does not nor did not want to go anywhere.my understand is thru my investigation is that mrs moore told said land owner if he didnt do these things they would take him to court.as was also my understanding she was park out and sitting in here vehicle looking at the mans property is how he come to have conversation with moore.he wanted to know why she was sitting in her vehicle in front of the mans house.so how convenient that moore spoke and lundy's handy man charged.
well jan 13 at the one of a kind board meeting lundy stated that the board would be meeting in executive (this week) session memory serves me right to work on the budget.well guess what to the best of my knowledge that meeting has not happened.should we the citizens be cocerned!
i personally think that at the landowners meeting we will be voting to undo some things that the board has done as i will be leading that and all i need is some seconds on it or maybe some motions made to put it to a vote then a second.
A when did the assn. go into the loaning of funds business of our dues monies.and when and who decide --board memebers voted to do this---i have some work that needs to be done here lundy can i have the assn. loan the money for me as well to have some things cleaned up.or is this one of those pick and choose things?will the office be notifing me of my 600.00 loan or does a handy man i choose go to you personally and get the check from the assn. before the work has even started.or does it need to be your handy man earnest hoyle?do ya'll have a sweet heart deal worked out.as i do have i witness that puts you and earnest hoyle in front of my entrance at top of hill sitting on the road stopped dead still and yall pointing and chatting at whats on my property.not only did this witness come by once but drove around the block a second time and lord and behold ya'll was still sitting there.hmmm guess in the words of some board members and paid office employee the board has always taken the high road and never singled anyone out.pic of my house in longiew news journal ,my name in news print same paper different edition,you the president lundy with your handyman sitting infront of my property for extended period of time.now does really look like ive been singled out.now does it.looks like i was first and foremost on a specific agenda list.you lundy do realize that records do reflect back atleast 11 years of me and my family being singled out that is in legal papers.
now the paid office employee has untill 6pm Sunday jan 25th and i will need a call from the board for a meeting at 6 pm at the cluhouse i am to be invite to read the resignation of the paid office employee as well as see her turn in all keys and codes and passwords and leave the property or i will be filing charges on monday in a felony count.this is and no way has nothing to do with the civil matters with cindy gill and whomever else and what entities they also involve.i understand this is in short notice but the meeting is already set and i have finally chosen to give a one time out on this one count of cindy gill.this is a choice and is in no means to be construed in any other way.there is no force no intemidation here gill. is well a where of the things she has done to me yes personally but remember she says ive never been singled out.please do understand that this was a very hard decision for me as a father with a family to make.but once i give written document with evidence on monday then i will enforce all charges to the very fullest extent of the law.i will seek incarceration in the penatentary as well what ever else the law prescribes as it is known to me be restitution as well that amount to be made by the jury or judge which ever one mrs gill you would seek to have trail of.

So now that we have realized that the Landowner's Association's bad business has occurred for years and is still occurring, isn't it time for us to end this mess?

We spend money for nothing!

We have meetings for nothing!

We have rules that mean nothing!

We have people who create problems for their neighbors in the name of this association for what????

NOTHING!

I ask everyone who reads this to understand my request, we need to shut this Landowner's Association down.

This can be done!

This should be done!

All it takes is a few smart people getting together and discussing the proper process.

We should do that!

Dear Glenwood Acres Landowners,
In November the board of directors sent out a letter to all landowners advising them that in an
effort to firm up our deed restrictions in 180 days they would begin to enforce all of our by-laws,
& CC&Rs. According to law they could have picked a much shorter period but in an effort to be
fair to eveiyone in a difficult time they chose 180 days.
One of our landowners chose to start a petition to oust the President instead of bringing his
property into compliance. Mr. Mc Fadin has spent thousands of dollars in this effort. This
landowner has accused Mr Lundy of theft, fraud, pequry, ill will toward the handicapped, being
gay and even fleeing another state to avoid prosecution. Not only is the landowner accusing Mr.
Lundy of nonexistent crimes someone is harassing, threatening and vandalizing his property. His
car has been egged, his tires flattened and people are even urinating in
his yard. It has reached such an extreme that Mr. Lundy has spoken to an attorney and will
seek damages in court. The attorney said that since Mr. Mc Fadin wrote threats of
physical violence on the internet against Mr. Lundy the case should be a slam dunk if he does
retract and apologize. To date he has not apologized.
Mr Lundy is not a thief, nor has he committed fraud, or perjury. He does not harbor ill will
against the handicapped as he is himself a disabled veteran, as is one of his sans. Mr. Lundy also
has a severely handicapped son. Mr. Lundy has no charges of any kind against him anywhere
and has been married for 33 years and has 5 children. He and the other board members Larry
Pugh, Linda Moore and Paul Gill have done nothing illegal, underhanded or wrong.
The terrible thing that Mr. Lundy did do was to ask Mr. Mc Fadin and everyone else to pay their
dues and bring their property into compliance.
Our board of directors have followed our by-laws and deed restrictions and done a lot for our
association. A few of the things this board has done for the association are a new security system,
which helped to catch some teenagers vandalizing the pool, they had the pool resurfaced and
painted, new piping, new pump and filtration system. They also acquired a new covered area for
shade and protection for the pool monitors. The water level in our lakes had gotten dangerously
low, so the well was re-drilled, supplied with the proper size motor and water began to run to the
lakes again. Improved boat ramps, horseshoe pits and handicapped ramps for the bathroom and
pier.
Mr. Mc Fadin could not come up with enough valid signatures on his petition so now he has
started a proxy drive to oust the board. He has demanded that our President be removed from
office his keys taken away and thrown out of the building and Mr Mc Fadin made
President in his place. While the present board has been in office the Acres have improved
significantly and until Mr. Mc Fadin started his rants our reputation in the county was improving.
If Mc Fadm somehow manages to get into office I truly fear for our property values. Please come
to the Landowners meeting on February 14th at 2pm and support our President. Thank you for

you are right sir we do need to work together.there can be some
resolve made.change can be made.it may never be right on the other
hand sir.but none the less change has to be made for a positive and
effective change.but i am so dedicated to trying to make that one
last and so very crucial effort for not just my family but all of our
neighbors is neighbors out here.we need new guidance and some folks
with an open heart that will listen and not condemn and cast
judgement on each other.

now i am hearing that lundy is seeking to start a petition drive to
have one maybe two board members impeached.sir i say that if the
board members are violating there duties have an executive meeting
and vote them out.this impeachment drive i did should have never had
to have happen the board should have removed you lundy and still
should meet today and do that.but be advise lundy that if you do call
that meeting to have board members removed it could back fire and
just maybe just maybe those there excluding paul gill which has done
been voted off of the board by a majority or a quorum of the board
was reappointed by you sir and you alone sir.anyone dare to call me a
liar of this matter.
so any ways lundy this could back fire and they may just vote you out
if for nothing else than for being an embarrassment to the board and
to the subdivision.sir you are out of control.you think you are
unstoppable.you can do as you please and as you will.and how dare a
board member have there own ideas and beliefs that are different than
yours.

sir lundy i say you are a coward and are hiding behind the walls of
your home.you are on the phone trying to recruit people to be on the
board to do your work with you.you are seeking a few more
cronies .get out and talk to these folks face to face.

i turned in Friday in writing to the office asking to have meeting
with the board so just when will this meeting be?

sir lundy i challenge you to a debate on these issues concerning the
acres and the citizens of this community.i challenge you to a debate
on live news coverage you seem to like to be in the news with the
camera rolling and in print.i can have the debate set up.wont cost
you a Penney sir.i will pay for what ever cost are incurred out of my
own pocket.and i will even furnish coffee and soda's for everyone.i
say we do it right out here in our club house with any one that wants
to attend and see first hand and be our VIP's.
sir if you need to have mr board attorney there to advise you i do
not object to that.if you want him to speak for you now that would be
a whole different matter.so i guess if that be the case i would be
willing to have debates with caritker as well
change is coming the peoples will will be heard.you sir will be held
accountable to the people and for the people of all your actions that
you did in dereliction of your duties.as well as the laws that you
violated.weather they be found criminal or civil you will be charged
for the people and brought to court by the people.


sir i would be mindful to remind that purgery in court is very
serious matters.as purgery was committited by the assn. in the alvis
case.you may really need to think of where you stand and what you
have to loose out on.you really should put some extra effort into
this.think of your family,friends and all of our neighbors.can this
community really stand much more embarrassment and deception.the
overwhelmingly majority believes this is a dysfunctional business
that has been corrupt so long it can never be turned around.

it is today and help get it into compliance with state statutes and
stop this madness that is so so severely splitting of
community.putting neighbors against neighbors.

just a side note ;i was told yesterday evening that i the board and a
select few was talking about me and what to do.my understanding.and
that i was said to be a trouble make and so the talk was just ignore
mcfadin and he will go away.well this man told man in this in depth
conversation we had that well its been 2 and half years and I'm
still here looks like you are not going anywhere.sir i want to say
thank for inviting me to speak with you and all the people thank you
as well.

i also would advise those that lundy has called seeking there
personal help in these matters that you think about what is going on
and make sure you have enough facts about all things to make a well
informed decision for you and your family .these decisions of today
make in fact may a impact on this subdivision for many many years to
come.

I personally encourage all those that lundy has been trying to
recruit to be one of his cronies to encourage him to do the debate
and explain himself in a very truthful manner when asked what ever
questions he is asked.as i am very well prepared and ready to do this
even with a short notice.i will not do this for myself but for the
people i will do this so there voices may be heard.i will just shoot
from the hip so to say as i do not read from a script.

From FM 726 front gate entrance continue on Glenwood Drive to Maplewwod turn right and go over damn.

From hwy 300 go to Fm 3358 to Greenhills road till see sign at back entrance Glenwood Acres
take a left at stop sign then an immediate right will be Parkwood stay till Glenwood Drive take right then take a right on Maplewood go over damn and your there.

This will be a time for those concerned about the Issues and what to
do,to be discussed.

I have invited Chanel 7 news to be here as well.

I ask that all whom are concerned to come and lets here ideas and opinions.

Just a note ; I do not advocate , encourage ,or promote violence.

If some one indeed is doing the things to Lundy's property that he himself have said and that Snider has said has been done i strongly discourage it.This type of behavior is not healthy for anyone and is highly illegal.violence breeds violence and it is immoral.i am very much against that kind of behavior.I have no time nor tolerance for that kinda of acts.It is wrong and it doesn't matter to whom it is done to.

What is happening is democracy in its rawest form.These are life
changing events that so few people ever get to witness.One only

I think Russell McFaddin is a true nutcase...he rambles on like a crazy man...all he was asked to do was pay his dues and clean up his trash dump property...Russell, all the money you spent on your farce of a website and railings against others you could have used to set an example for others in the mobile home section to follow in cleaning up the community...what's up with your prioritys, man?? Get a life...........

Hey Russell...why do you need to have a document with all Gala landowner's names, addresses, and respective property values on it and telling others what thoses values are when it's no one elses business but that landowners...do we just need to feel powerful to overcome our Little Hitler complex? You know I could reveal my identity, but I'm afraid my property would be vandalized in some way, just as others' that have spoken out against you and your toadies, have had to suffer...quit hiding behind sheeps clothing and goodwill bullshit...your just a punk and shouldn't be given the time of day...especially by the news media... only serves to feed your little ego and bring everyone's property values down...have a nice day...

For those of you who have so little to be entertained with that you have to resort to reading this poop about what goes on in "Sinwood Acres", I say that the dialog between Charles Snider and Russell Mcfaddin really reveals who is in control of the facts and who is full of crap...Mr. Snider did not become the successful businessman he is today through stupidity,dishonesty, or by cheating others...he is a good man who I am proud to call my friend...thanks for being there for all of us, Charles...we're with you in every way....
